These terms and conditions tell you who we are, how we will provide products to you, how you and we may end the contract, what to do if there is a problem and other important information. Please read them carefully before placing an order. By using this website or placing an order you agree to be bound by these terms.

1About us

Ava Noir is a trading name of The Amexa Group, a company registered in England and Wales under company number 16714235.

We operate the website at www.avanoir.co.uk ("the site"). You can contact us at any time by email at info@amexagroup.co.uk. When we refer to "we", "us" or "our" in these terms we mean Ava Noir. When we refer to "you" or "your" we mean the person placing an order or using the site.

2Definitions

  • Goods means the products we advertise and sell on the site.
  • Order means your request to buy goods from us.
  • Contract means the legally binding agreement between you and us for the sale and supply of goods.
  • Consumer means an individual buying goods wholly or mainly for personal use and not for business.

3Age restriction and eligibility

The site sells products that are intended for adults only. You must be at least 18 years of age to browse the site, register an account or place an order. By using the site you confirm that you are 18 or over.

We reserve the right to ask for proof of age at any point and to refuse or cancel any order where we reasonably believe the buyer is under 18. It is a criminal offence to buy or attempt to buy age restricted goods on behalf of someone under 18.

4Your account

You do not need an account to place an order, but you may choose to create one. If you create an account you are responsible for keeping your login details confidential and for all activity that takes place under your account. Please tell us straight away if you believe your account has been accessed without your permission.

You agree to provide accurate and current information when you register or order. We may suspend or close an account if we reasonably believe these terms have been breached.

5Placing an order

Our order process lets you check and amend any errors before submitting your order. Please take the time to read and check your order at each stage.

When you place an order you are offering to buy the goods. We will send you an acknowledgement email confirming that we have received your order. This acknowledgement does not mean your order has been accepted.

A binding contract between you and us only comes into existence when we send you a dispatch confirmation email telling you that the goods have been sent. If we cannot accept your order we will let you know and will not charge you. This might be because the goods are out of stock, because of an error in the price or description or because we are unable to verify that you are over 18.

6Price and payment

The price of the goods will be the price shown on the site at the time you place your order. Prices include VAT where applicable. Delivery costs are shown separately and added at checkout.

We take care to ensure prices are correct, but it is possible that some products may be incorrectly priced. If the correct price is higher than the price shown we will contact you before we accept your order and you may choose to continue at the correct price or cancel. We will not be obliged to supply goods at an incorrect price.

Payment is taken at the point of order through our payment provider. We accept the payment methods shown at checkout. By submitting payment details you confirm that you are authorised to use the chosen payment method.

7Delivery

We deliver to addresses within the United Kingdom and to the destinations listed at checkout. Delivery costs and estimated timescales are shown before you complete your order and on our Delivery page.

Delivery timescales are estimates and are not guaranteed. We will do everything we reasonably can to deliver within the times stated, but we are not responsible for delays caused by events outside our control or by you providing an incorrect or incomplete address.

The goods become your responsibility from the time we deliver them to the address you gave us. You own the goods once we have received payment in full.

8Discreet packaging and billing

We understand that privacy matters. All orders are sent in plain, unbranded outer packaging with no description of the contents on the outside. The sender name on the parcel will be neutral and will not reveal the nature of the goods.

The descriptor that appears on your bank or card statement will be discreet and will not identify the products purchased. Full details are on our Discreet Packaging page.

9Cancellation and returns

If you are a consumer you have the right to cancel most orders within 14 days without giving a reason, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. The cancellation period ends 14 days after the day you receive the goods.

To cancel you must tell us clearly within that period. You can email us at info@amexagroup.co.uk. You must then return the goods to us without undue delay and within 14 days of telling us. You are responsible for the cost of returning the goods unless they are faulty.

Hygiene exemption on intimate products

Please read this carefully. For reasons of hygiene and health protection, your right to cancel does not apply to sealed goods once they have been unsealed after delivery. This is permitted under Regulation 28 of the Consumer Contracts Regulations 2013.

In practice this means that intimate products, including but not limited to sex toys, lingerie that is worn next to the skin, and similar personal items, cannot be returned for a refund once the hygiene seal or packaging has been opened or removed, unless the item is faulty. Items returned in their original, sealed and unopened condition can be refunded in line with this section.

Where you are entitled to a refund we will refund the price you paid for the goods and the standard delivery cost. We may reduce your refund to reflect any loss in value of the goods caused by handling beyond what is necessary to establish their nature and function. We will make the refund within 14 days of receiving the goods back or of receiving proof that you have sent them, using the same payment method you used to order.

10Faulty or incorrect goods

Nothing in these terms affects your legal rights. Under the Consumer Rights Act 2015 the goods we supply must be as described, fit for purpose and of satisfactory quality.

If goods arrive faulty, damaged or not as described, please contact us as soon as you can. Your rights to a repair, replacement or refund are not affected by the hygiene exemption above. If you are returning faulty goods we will cover the reasonable cost of return. We may ask for a description of the fault and photographs to help us resolve the issue quickly.

11Product information and safe use

We try to make sure that descriptions, images, colours and sizing on the site are accurate, but slight variations can occur and packaging may change. Images are for illustration only.

Our products are intended for adult personal use and are not medical devices. Please read any instructions, material information and warnings supplied with the product before use. If you have a known allergy, for example to latex, check the listed materials before buying. If you have any health concern about using a product please seek advice from a qualified medical professional. We are not liable for any harm caused by misuse or use contrary to the supplied instructions.

12Promotions and discount codes

From time to time we may offer discount codes, sale prices or other promotions. Unless we state otherwise, only one discount code may be used per order, codes have no cash value and cannot be exchanged for cash, and codes may be withdrawn or amended at any time. We reserve the right to cancel orders where a code has been used fraudulently or in breach of its terms.

13Intellectual property

All content on the site, including text, graphics, logos, images and the Ava Noir name, is owned by us or our licensors and is protected by intellectual property law. You may view and print pages for your own personal use, but you may not copy, reproduce or use any content for commercial purposes without our written permission.

14Acceptable use and reviews

You agree not to use the site for any unlawful purpose, to attempt to gain unauthorised access to it or to introduce harmful material such as viruses. If you submit a review or other content you grant us a licence to use, display and reproduce it. You are responsible for the content you submit and it must be accurate, lawful and not offensive. We may edit or remove content that breaches these terms.

15Privacy and cookies

We take your privacy seriously and handle your personal data in line with UK data protection law. Please read our Privacy Policy and Cookie Policy to understand how we collect and use your information.

16Our liability

We do not exclude or limit our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud and for any breach of your legal rights as a consumer.

Subject to the above, we are not liable for losses that were not foreseeable, for losses that arise from your failure to follow product instructions, or for any business losses, as our products are supplied for private and domestic use only.

17Events outside our control

We are not responsible for any failure or delay in performing our obligations where this is caused by an event outside our reasonable control, including strikes, supplier failure, postal delays, extreme weather or any act of government. If such an event happens we will contact you as soon as we can and take steps to limit the effect on you.

18Complaints

We want every order to go smoothly, but if something goes wrong please tell us. Email us at info@amexagroup.co.uk with the details and we will respond as quickly as we can and work with you to put things right.

19Changes to these terms

We may change these terms from time to time, for example to reflect changes in the law or in how we operate. The terms that apply to your order are those in force on the date you place it. Please check this page before ordering so that you are aware of any changes.

20Governing law

These terms are governed by the law of England and Wales. Any dispute will be subject to the non exclusive jurisdiction of the courts of England and Wales. If you live in Scotland or Northern Ireland you may also bring proceedings in your local courts.
